Boatsbank Privacy Policy

The Boatsbank portion of the Boats.com site ("Boatsbank Site") is owned and operated by Dominion Enterprises ("Boats.com"). The following privacy statement describes the practice of the Boatsbank Site with respect to the collection, maintenance and disclosure of personal information in the Boatsbank Site. This privacy statement applies only to the Boatsbank Site and it does not apply to the information collection practice on the other parts of the Boats.com site. Categories of Personal Information Collected and the Means of Collection

On the Boatsbank Site you can complete a pre-application form for a loan application for financing of your purchase of a new or pre-owned boat or a new engine and Boats.com will forward your completed pre-application form to a financial institution or loan brokerage ("Lender") for financing consideration. To facilitate this financing consideration of your purchase of a new or pre-owned boat or a new engine by Lender, Boats.com collects non-public personal information ("NPPI") from the following sources:

Online Pre-Application: Boats.com collects NPPI from you through the online completion of a pre-application form (information such as your name, address, social security number and other financial information). In addition to the information we collect that is necessary to process your pre-application form, Boats.com collects additional NPPI from your pre-application form (information such as personal financial information, boat information, boat category, engine information, boat accessories and options, and trade-in information).

Boats.com may also collect additional NPPI about your transactions with us, our affiliates and non-affiliated third parties, as well as information that we may receive from a consumer reporting agency.

Boats.com's Use of Non-Public Personal Information

NPPI collected on the Boatsbank Site is used primarily for the purposes it is requested, that is, for the evaluation of your qualifications by Lender to obtain financing.

Boats.com may also use the NPPI to perform aggregate analyses of the Boatsbank Site customer base. This information may be used to deliver better, more relevant products and service offerings to you. In addition, Boats.com may provide aggregate analyses containing no personally identifiable information to selected third parties for the purposes of establishing, for example, advertising prices on the Boatsbank Site.

Boats.com may use NPPI collected to contact you in connection with any inappropriate use of the Boatsbank Site, non-compliance with the Terms of Use, in connection with a complaint registered by another site visitor, or as permitted by law.

Types of Personal Information We Disclose

Boats.com may disclose the following types of NPPI that we collect from the Boatsbank Site: Information we receive from you during the pre-application process, such as your name, address, email address, other contact information, and boat and engine information.

Companies With Whom We Share Your Personal Information

Boats.com may disclose NPPI that we collect from the Boatsbank Site to the following types of third parties:

Financial Service Providers: In order to process pre-application forms, Boats.com will transfer personal information to, for example, Lenders and other financial service providers such as loan brokers and companies offering consumer financing and credit information.

Non-Financial Service Providers: Boats.com may disclose NPPI to industry partners such as marine industry manufacturers and service providers that Boats.com has identified as offering valuable services.

Joint Marketers and Service Providers
Boats.com may disclose the following information to nonaffiliated third parties that perform marketing services on Boats.com's behalf or to other financial institutions with whom we have joint marketing agreements: Information we receive during the pre-application process, such as your name, address, email address, other contact information, and information about your transactions and experiences with companies related to Boats.com.

Others
Boats.com may disclose all the NPPI it collects to nonaffiliated third parties as permitted by law. In the event that Boats.com merges with another business entity or substantially all of its assets related to the products or services which you receive from us are acquired by another business entity, its is likely that NPPI will be one of the assets transferred to the other business entity. In the event of such a merger or acquisition, Boats.com reserves the right to disclose the NPPI it collects to the other business entity pursuant to the terms of this privacy policy.

Additional Disclosure Permitted by Law
Boats.com may disclose NPPI when requested by a court order, search warrant, or subpoena or if Boats.com in good-faith believes that such action is necessary in order to conform with the requirements of law. In these limited situations, Boats.com will notify you, if allowed, before making the required disclosure unless prior notification is not possible by virtue of the deadline imposed by the legal requirement, in which case Boats.com will notify you as soon as possible after disclosure occurs, if allowed.

Your Right to Control Personal Information ("Opt-In")

We will not disclose your NPPI, except as permitted by law, unless you "opt-in" to such disclosure during the pre-application process. To allow the disclosure of your NPPI to nonaffiliated third parties, for the promotional use of your NPPI, you must click the appropriate button at the end of the pre-application process indicating that Boats.com may disclose your NPPI and use it for promotional purposes. Your election(s) to opt in will apply to all products and services you may obtain from the Boatsbank Site.

If you have allowed Boats.com to disclose your personal information, but wish to change your mind at a later time, you still can opt out later by sending an email to Boats.com with a request to opt out to customersupport@boatsbank.com. Additionally, Boats.com grants you the ability to correct, update and modify your NPPI collected on the Boatsbank Site. If you wish to review, correct, update or modify your NPPI, please send an email from the address indicated in your pre-application form to customersupport@boatsbank.com.

Health or Medical Information
Regardless of whether you have opted in, we will not share any personal health or medical information we may have without your written consent or otherwise as permitted by law. Health or medical information may include insurance application information, other health information you may provide in connection with one or more existing accounts, or information provided to us with regard to an insurance claim.

Cookies
Boats.com, including the Boatsbank Site, uses cookies, which are small text files that are stored on the site visitor's computer, to gather and keep track of information such as search result preferences, country preference and auto-login information. The Boatsbank Site uses session cookies to facilitate your use of the Boatsbank Site. Cookies also help Boats.com review Boatsbank Site traffic patterns and improve the Boatsbank Site. Although many browsers are set to accept cookies, you can set your browser to reject cookies, but this will prevent you from using most of the features of the Boatsbank Site including the application.

Log Files
Boats.com uses IP addresses to analyze trends, administer the site, track site visitors' movements, and gather broad demographic information for aggregate use. Boats.com stores information regarding IP addresses and the above described cookies in its secure servers. Boats.com does not disclose an individual's personal information to third parties that may be collected in these log files except as stated in the above section entitled "Disclosure Permitted by Law".

Confidentiality and Security

Boats.com takes reasonable means to protect your personal information. When you submit sensitive information via the Boatsbank Site at Boats.com's request, such information is protected both online and off-line.

When our pre-application form asks you to enter sensitive information that information is encrypted and is protected with the encryption software SSL. While on a secure page, such as our pre-application page, the lock icon on the bottom of web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked.

While we use SSL encryption to protect sensitive information online, we also take the following steps to protect user-information off-line. Access to your information is restricted in our offices. Boats.com restricts access to your information to those employees who need to know the information to provide products or services to you, or to develop or maintain the Boatsbank Site. Finally, the servers on which we store information are kept in a secure environment. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.

Changes to Privacy Statement
Boats.com reserves the right to modify this privacy statement from time to time in its sole discretion. A notice that Boats.com made changes to the Boatsbank Site privacy statement will be posted in a conspicuous place on the Boats.com home page as well as on all other pages of the Boatsbank Site. If, at any time, Boats.com proposes to use personal information in a manner that is different from the privacy statement in effect at the time information was collected, Boats.com will notify you via the email address you provide in the pre-application process. You will be given a choice to opt-out of Boats.com use of your NPPI in the manner proposed in the new policy and a reasonable time to respond to the email.

The financial institution processing your loan request is required by law to provide you a copy of its Privacy Policy. To continue with this request, we must get your agreement to receive their Privacy Policy at a later date. If you agree, the financial institution will mail their Policy to you when they receive your application. If you do not agree, unfortunately, we cannot complete this loan request over the Internet. By agreeing to this Privacy Policy, you agree to receive their Privacy Policy at a later date.
